What are the acceptable forms for Age Identification?

 

  • Licence Endorsements
  • The Liquor Licence Act allows for the addition of a variety of special conditions to a sales licence which will alter the normal circumstances under which alcohol may be sold and served.  This special condition is referred to as a licence "Endorsement".

    The holder of a "sales" licence may apply to the Commission for any of the following eight types of endorsements, each of which has its own rules and regulations you must follow:

    Catering Endorsement

    The holder of a catering endorsement may sell and serve liquor at a catered event in an unlicensed area of a licensed establishment and at a catered event away from the licensed premises in an unlicensed area where a Special Occasion Permit would otherwise be required.  Light meals must be offered at the catered event.  For example, a catering endorsement would allow you to cater liquor and food to weddings, private parties, etc.

    Mini Bar Endorsement

    The holder of a mini bar endorsement may sell and serve liquor in a licensed establishment and from a dispenser (a mini bar) in a room that is rented for overnight accommodation in a facility adjacent to the licensed establishment.

    Room Service Endorsement

    The holder of a room service endorsement may sell and serve liquor in a licensed establishment and to people registered as guests in a room that is rented for overnight accommodation in a facility adjacent to the licensed establishment.  Food must be available.

    Brew Pub Endorsement

    The holder of a brew/wine pub endorsement may sell and serve beer or wine that is manufactured on the premises by the licensee.  The licensee must own and operate both the pub and the manufacturing facilities.  The beer or wine must be sold and consumed only in the licensed area.

    Wine Pub Endorsement

    The holder of a wine pub endorsement may sell and serve wine that is manufactured on the premises by the licensee.  The licensee must own and operate both the pub and the manufacturing facilities.  The wine must be sold and consumed only in the licensed area.  The holder of a wine pub endorsement, consistent with manufacturing wine on the premises, must perform the minimum steps of fermenting, filtering, carbonating and, where appropriate, bottling on the premises.

    Golf Club Endorsement

    A golf course operator who currently holds an active liquor sales licence may apply to the AGCO to sell and serve liquor for consumption on the playing area of the golf course.

    Stadium Endorsement

    A stadium endorsement permits the sale and service of beverage alcohol in the fixed tiered seats of a stadium that is used primarily for live entertainment events or live professional sporting events.  Liquor sales licensees issued a stadium endorsement are required to obtain approval by the Registrar of Alcohol and Gaming for sale and service of liquor on an event-by-event basis.

    Bring Your Own Wine (BYOW) Endorsement

    A bring your own wine endorsement authorizes the holder of a liquor sales licence for a restaurant or for a banquet room located in a hotel or motel to permit patrons to bring unopened bottles of commercially made wine into the restaurant or banquet room to which the licence applies, for their own consumption.  A restaurant employee must open the wine, as would be the case if the patron had purchased the wine from the establishment.  The wine must have its manufacturer's seal intact when presented to the restaurant employee for opening.

  • Application for a Liquor Sales Licence
  • Anyone who wants a Liquor Sales Licence must apply to the Registrar of the Alcohol and Gaming Commission of Ontario.  The application process takes a minimum of six to eight weeks, and may be longer if there is a public objection to the licence.

    When deciding whether a licence should be issued, the Registrar may consider such factors as:

    • the potential effect on residential neighbours;
    • the applicant's previous experience in the hospitality industry;
    • the financial viability of the business (including the operator's ability to pay Retail Sales Tax);
    • whether the premises comply with the Liquor Licence Act and Regulations, municipal zoning;
    • bylaws, fire and health laws;
    • whether the establishment offers a variety of meals;
    • whether the municipality allows the sale of wine, beer and/or spirits;
    • the applicant's criminal record.

  • Do's and Don'ts of Ontario's Liquor Laws
  • These are a few of the important rules covered under Ontario's liquor laws:

    Don't:

    • Let people under the age of 19 drink.
    • Encourage excessive drinking or serve alcohol to anyone you suspect may already be intoxicated.
    • Permit drunken, quarrelsome, violent or disorderly conduct.
    • Permit anyone in a licensed establishment to hold, sell, distribute or use illegal drugs.
    • Serve smuggled, home-made or watered-down liquor.
    • Allow guests to take out or bring in liquor.
    • Raffle liquor or hold contests that involve buying, drinking or winning liquor.
    • Discount the price of alcoholic beverages.
    • Sell liquor from a vending machine.
    • Allow noise from the premises to disturb the neighbours.

    Do:

    • Make sure that you understand the Liquor Licence Act and Regulations.
    • Encourage responsible drinking.
    • Post your Liquor Sales Licence or Special Occasion Permit.
    • Train your staff in responsible serving practices. Have all staff take the Smart Serve Responsible Alcohol Beverage Service Training program.
    • Serve alcohol only within the allowed hours.
    • Serve and promote food and a variety of non-alcoholic drinks.
    • Sell only liquor that was bought on your licence or permit through the Liquor Control Board of Ontario (LCBO), The Beer Store, or Ontario Wine Stores.
    • Make sure that the number of people on the premises is within the lawful capacity.
    • Ensure that the premises comply with all zoning by-laws, the Building Code Act, the Fire Marshals Act and the Health Protection and Promotion Act.
    • Check the identification of people you suspect are under 19 years of age.
    • Ensure that employees serving liquor are at least 18 years of age.
    • Create and enforce house policies that promote responsible service and moderate drinking practices.

  • Eligibility for a Liquor Sales Licence
  • In order to apply for a liquor sales licence, you must be a Canadian citizen or landed immigrant.  If the applicant for the licence is a corporation, more than 50 percent of the corporation's directors must be Canadian citizens or landed immigrants.

    The establishment must be supervised by someone with at least six months' experience in the food and alcoholic beverage industry.  Licence applicants who do not have enough experience must hire a full-time experienced person to manage the food and beverage service for the first three months of operations.

    It is strongly recommended that all licensees, managers, and servers take the Smart Serve responsible training program.

  • Hours of Alcohol Service
  • Liquor may be sold and served during the following hours:

    Licensed establishments:
    Monday to Sunday: 11 a.m. to 2 a.m.
    New Year's Eve (December 31): 11 a.m. to 3 a.m.

    Special Occasion Permit events:
    Monday to Saturday: 11 a.m. to 1 a.m.
    Sunday: 12 noon to 1 a.m.
    New Year's Eve (December 31): 11 a.m. to 2 a.m.

    Serving hours remain the same on federal, provincial and municipal election days.

  • Legal Drinking Age
  • In Ontario the legal age to drink alcohol is 19 years old.  The legal age to serve alcohol in a licensed establishment is 18 years old.  "Serving alcohol" includes taking drink orders, taking payment for alcoholic beverages, stocking the refrigerator or bar area, and bartending.

  • Mandatory Signage
  • Licensed bars and restaurants, brew-on premise facilities and stores that sell alcohol beverages must now post signs warning women that drinking alcohol during pregnancy can cause Fetal Alcohol Spectrum Disorder.  The signs must be at least 8 X 10 inches and must be prominently displayed.  Failure to comply with the signage requirements is an offence under the Liquor Licence Act.  To download a copy of this sign go to: www.agco.on.ca/en/b.alcohol/warningsign.html

  • What are the acceptable forms for Age Identification?
  • The only acceptable forms of age identification include:

    • an Ontario driver's licence with a photo
    • a Canadian passport with a photo
    • a Canadian citizenship card with a photo
    • a Canadian armed forces card with a photo
    • a photo card formerly issued by the LLBO
    • an LCBO BYID photo card
